Stan Chalvire Comments on Long-Standing Trademark Question Before the Supreme Court in Mass Lawyers Weekly Article

M0846516In the Massachusetts Lawyers Weekly article Long-standing trademark question before Supreme Court, intellectual property attorney Stan Chalvire commented on the issue of what becomes of a licensee’s right to use a trademark when the licensor rejects the license as part of the bankruptcy process. The International Trademark Association refers to the issue as “the most significant unresolved legal issue in trademark licensing.” Regarding the issue, Stan notes that though “the Supreme Court may urge Congress to make a legislative fix, [the] argument that rejection of contract should not give the estate any more rights than it would have if it did not declare bankruptcy seemed to have struck a chord with several of the justices.”
