Patent Attorney Andrew BuninOn Wednesday, April 17th MBBP Attorney Andrew Bunin, a former patent examiner, is sitting as a panelist for a Boston Patent Law Association event titled “Communicating with the USPTO - How to (hopefully) obtain favorable results when interacting with examiners and the USPTO“. The event is meant to provide some insight into how the Patent Office operates on a day-to-day basis. Andrew, along with three other panelists, will discuss how changes to laws and the Manual of Patent Examining Procedure (MPEP) affect the patent examiners, office actions, and interviews as well as how this insight can be used to obtain more favorable results when dealing with examiners and the USPTO.

On Tuesday, April 23rd MBBP is hosting a complimentary breakfast program titled “Noncompetition Agreements: Protecting Customer Relationships & Confidential Information“. Employers often ask: “Are our non-compete agreements with employees enforceable?” The answer often depends on whether the employer took the necessary steps to put an effective agreement in place. Courts in Massachusetts generally will enforce reasonable agreements when necessary to protect particular employer interests, such as customer relationships and trade, from misappropriation. On the other hand, courts generally do not enforce non-compete (or non-solicit and non-disclosure agreements) when no real protectable interests are at stake, the restrictions are unreasonable, or the employer has undermined its ability to enforce them.

This Program will identify the steps employers can take to increase the likelihood that a court will enforce its restrictive agreements with employees, provide education and insight into how such agreements are enforced by employers, and de-mystify the litigation process. We will also review recent legal developments that may affect whether the agreements you currently have in place with employees are vulnerable to attack by departing employees.

Our presenters have decades of experience advising employers and litigating cases in this area and we expect that attendees will bring a wealth of knowledge and experience to the program. Through discussion, we expect a very enlightening exchange of practical ideas and a range of employer experiences.

Mass Life Sciences Center Launches Accelerator Loan Program 01/07/2013

Massachusetts Life Sciences Center

On January 4, the Massachusetts Life Sciences Center announced it was launching the second year of its Accelerator Loan Program, in which early-stage life sciences companies apply for the opportunity to receive working capital to aid in the process of developing their science or technology, and to position these companies for subsequent investment. This year, loans for this program will be capped at $1 million per company. Applications are now being accepted and are due by February 8, 2013.

To date, the Accelerator Program has awarded $15.1  million in loans to 24 companies, six of which have paid back their Accelerator loans early with interest after generating more than $105 million in equity or acquisition proceeds.

Bob will lead a discussion concerning recent changes to the Massachusetts Criminal Offender Record Information (“CORI”) law. The changes extend eligibility for access to the CORI database to all employers but also put strict notification, paperwork, and records retention requirements on employers who access and use CORI records.

On Wednesday, November 14th MBBP’s employment practice is holding an informational seminar on wage and hour claims and what employers can do to avoid them. Wage and hour claims across the U.S. are at an all-time high. The laws governing the payment of wages, overtime pay, vacation pay, compensable working time and commissions, and the use of independent contractors, have become a leading source of employee claims and employer liability. Mistakes can be very costly because penalties in Massachusetts include mandatory treble damages and attorneys’ fees, as well as potential civil and criminal liability for individual corporate officers. On Tuesday, October 2nd MBBP is hosting a joint event with McGladrey, LLP on the 2012 round of the MLSC Tax Program. In order to expand life sciences-related employment opportunities, promote health-related innovations and stimulate research and development, manufacturing and commercialization in the life sciences, the Massachusetts Life Sciences Center is offering tax incentives in 2012 to companies engaged in life sciences research and development, commercialization and manufacturing in Massachusetts. The Life Sciences Initiative authorizes the Center to award up to $25 million in tax incentives each year.

The primary goal of the Program is to incentivize life sciences companies to create new long-term jobs in Massachusetts. To qualify companies must receive certification from the Center and must demonstrate both the scientific and academic merit of their expansion plans.

Corporate Attorney Carl BarnesOn June 13th, MBBP attorney Carl Barnes was a panelist at a seminar on crowdfunding sponsored by the Massachusetts Association of Technology Transfer Offices. The seminar, entitled “Crowdfunding for University Startups – learn how TTOs will be able to use the JOBS 2012 Act to help their start-ups raise early stage funding,” was held at the Cambridge Innovation Center. Crowdfunding won’t become a reality until the SEC adopts regulations implementing Title III of the JOBS Act – and that’s not scheduled to happen until much later this year. In the meantime, there is still a great deal for entrepreneurs to learn and consider.

On June 14th, the the MIT Enterprise Forum’s New England Games SIG is hosting an event at the Microsoft NERD Center in Cambridge on “Can Games Save Education?.” Games dominate interactive time with young learners and have proven their ability to engage, entertain, teach and impact. Can games really impact education as we know it today? The event will be comprised of a panel discussion that will take a focused look at the state of education and the reality of changing education in a 21st century way.  The panel of Becker College President, Robert Johnson, and  Muzzy Lane CEO, Dave McCool, (with additional panelists to be announced) will discuss:

  • Game developers have long understood that there are different types of game players and have developed different games and elements to touch everyone from grandmothers to marines. Can/will educators turn to a customized form of education? Is there a way to get teachers and school districts to change or is there just too much inertia?
  • Games have a proven business model, while education is mired in a slow mature market, will games have to make their impact as adjunct material or is there room in the mainstream? Can we learn something from the business model of games? Are parents a better target customer than school districts?
  • What are the biggest risks in converting to game based education? Who do you see as leaders in taking these risks?
